Certified Pre-Owned Device Warranty

1. Purpose 

The Certified Pre-Owned Device Warranty applies to eligible Certified Pre-Owned Devices sold by Tech-Eyes Canada Limited. 

Each Certified Pre-Owned Device undergoes inspection, functional testing, cleaning, and quality assurance in accordance with Tech-Eyes' internal certification standards before being offered for sale. 

This warranty covers eligible defects affecting the normal operation of the device during the applicable warranty period. It applies specifically to the Certified Pre-Owned Device and does not constitute a warranty for the entire device beyond the coverage described in these Terms & Conditions. 

2. Definition of a Certified Pre-Owned Device 

A Certified Pre-Owned Device is a previously owned electronic device that has been inspected, tested, cleaned, and approved by Tech-Eyes in accordance with its applicable certification standards. 

Certification confirms that the device met the applicable functional requirements at the time of sale. It does not mean that the device is new or free from cosmetic signs of previous ownership. 

3. Warranty Period & Start Date 

Warranty coverage begins on the date the customer purchases the Certified Pre-Owned Device, unless otherwise stated. 

The applicable warranty period will be communicated before purchase and recorded on the customer's invoice, receipt, or digital purchase record. 

Customers should retain their proof of purchase, as warranty service may require verification of the original transaction. 

4. What the Warranty Covers 

The warranty covers eligible hardware defects that: 

  • Affect the normal operation of the Certified Pre-Owned Device; 

  • Occur during the applicable warranty period; and 

  • Are not caused by misuse, accidental damage, or another excluded circumstance. 

Eligible defects may include verified failures of internal hardware components that should reasonably function during ordinary consumer use following Tech-Eyes' certification process. 

Where a warranty claim is approved, Tech-Eyes may repair the device, replace the affected component, exchange the device for the same or an equivalent Certified Pre-Owned Device, or provide another appropriate warranty remedy. 

5. Cosmetic Condition 

Certified Pre-Owned Devices are not brand-new products. Minor cosmetic imperfections, including light scratches, small scuffs, or other signs of previous ownership that fall within the disclosed cosmetic grade, are not considered warranty defects. 

Customers are encouraged to inspect the device and confirm its disclosed cosmetic condition before completing the purchase. 

Cosmetic characteristics consistent with the disclosed grading standard do not qualify as grounds for a warranty claim. 

6. What the Warranty Does Not Cover 

The warranty does not cover: 

  • Accidental damage, including drops or impacts; 

  • Cracked displays or other physical damage; 

  • Liquid or water damage; 

  • Theft or loss; 

  • Fire or electrical surges; 

  • Misuse, neglect, or improper handling; 

  • Unauthorized repairs or attempted self-repair; 

  • Unauthorized opening or modification of the device; 

  • Software modifications, rooting, or jailbreaking; 

  • Malware or unrelated software issues; 

  • Normal battery degradation caused by ordinary ageing; 

  • Cosmetic damage occurring after purchase; or 

  • Failures caused by incompatible or unauthorized accessories, chargers, or external equipment. 

Warranty coverage may be affected if the device is opened, modified, repaired, or serviced by another provider without authorization from Tech-Eyes. 

7. Battery Health 

Certified Pre-Owned Devices are sold with batteries that meet Tech-Eyes' applicable certification requirements at the time of sale. 

Battery capacity naturally decreases through ordinary charging cycles. Gradual battery degradation is therefore not considered a warranty defect. 

Battery performance may qualify for warranty coverage where it falls below the applicable certification standard during the warranty period due to a verified defect. 

8. Warranty Claim Procedure 

Customers requesting warranty service should present the Certified Pre-Owned Device together with proof of purchase and any reasonably requested supporting information. 

Tech-Eyes may: 

  • Verify the original purchase; 

  • Inspect the device; 

  • Perform diagnostic testing; 

  • Verify warranty eligibility; 

  • Determine whether the reported issue is covered; and 

  • Communicate the proposed warranty resolution before beginning repair or replacement. 

Submission of a warranty claim does not guarantee approval. Warranty eligibility is determined based on the inspection findings and these Terms & Conditions. 

Customers should report suspected warranty defects as soon as reasonably possible after discovering them. Delays in reporting may affect Tech-Eyes' ability to verify the issue or determine its cause, where permitted by applicable law. 

9. Customer Responsibilities 

Customers are responsible for: 

  • Providing accurate information during the warranty process; 

  • Providing reasonable documentation required to verify the purchase; 

  • Making the device available for inspection; 

  • Cooperating with reasonable diagnostic procedures; 

  • Removing activation locks or other security features where required for diagnostics; and 

  • Backing up personal data before submitting the device for inspection, repair, or replacement. 

Tech-Eyes will take reasonable care during warranty service but cannot guarantee the preservation of personal data during diagnostics, repair, software restoration, or device replacement. 

10. Warranty Resolution 

Where a warranty claim is approved, Tech-Eyes will determine the appropriate remedy based on the nature of the defect, technical feasibility, repair practicality, replacement inventory, and applicable law. 

Where reasonably appropriate, Tech-Eyes may prioritize: 

  1. Repair of the device; 

  1. Replacement of the affected component; 

  1. Exchange for an equivalent Certified Pre-Owned Device; or 

  1. Another appropriate warranty remedy. 

A warranty remedy does not automatically restart, renew, or extend the original warranty period unless Tech-Eyes expressly confirms otherwise in writing. 

11. Replacement Device Standards 

A replacement device may be Certified Pre-Owned rather than brand-new. 

Where a replacement is provided, Tech-Eyes will make reasonable efforts to provide a device with substantially equivalent functionality, storage capacity, network compatibility, and overall value. 

The replacement device may differ in colour, cosmetic appearance, manufacturing date, or minor specifications where reasonably necessary. 

If an identical replacement is unavailable because the model has been discontinued or is out of stock, Tech-Eyes may offer an equivalent Certified Pre-Owned Device, repair the original device, or provide another appropriate resolution. 

12. No Cash Settlement 

Except where required by applicable consumer protection legislation, this warranty does not create an entitlement to cash compensation, refunds, or monetary settlements instead of an available warranty remedy. 

13. Customer Communication 

Tech-Eyes will make reasonable efforts to keep customers informed about warranty inspections, requests for additional information, repair progress, replacement availability, and warranty decisions. 

14. Delays Beyond Tech-Eyes' Reasonable Control 

Tech-Eyes will make reasonable efforts to process warranty claims promptly. However, delays may occur due to circumstances beyond its reasonable control, including supplier shortages, discontinued components, manufacturer delays, transportation disruptions, customs clearance, natural disasters, government actions, or other similar circumstances. 

15. Relationship with Other Programs & Statutory Rights 

This warranty operates independently from optional Tech-Eyes programs such as Tech-CtrlZ and Tech-PROtect. Those programs may provide additional benefits subject to their respective Terms & Conditions. 

Nothing in this warranty is intended to limit any rights or remedies available to customers under applicable Canadian consumer protection legislation. 

16. Practical Examples 

Covered Claims 

  • A Certified Pre-Owned Device develops a verified motherboard fault during ordinary use. 

  • A charging port fails because of an internal hardware defect. 

  • An internal speaker stops functioning because of a verified hardware or workmanship issue. 

Not Covered 

  • The device is dropped after purchase and the screen is damaged. 

  • The device suffers accidental water or liquid damage. 

  • Battery capacity decreases through ordinary ageing. 

  • The device is rooted or jailbroken. 

  • The screen cracks following an impact. 

  • The device is opened or repaired by an unauthorized third party.
