Purpose 

The purpose of this Privacy Policy is to explain how Tech-Eyes collects, uses, stores, discloses and protects personal information that it collects in retail stores, repair shops, on its website, in its ecommerce platform, through promotional programs and in its customer support. It is designed to create a sense of trust among customers by ensuring that personal information is handled responsibly, and to ensure adherence to applicable Canadian privacy laws, such as the Personal Information Protection and Electronic Documents Act (PIPEDA) and the other provincial privacy laws. This policy aims to explain the information that Tech-Eyes collects, its purpose, its retention period and customers rights to their information.

International Data Transfers 

Tech-Eyes may use third-party service providers who may process or store some personal information outside the customers province of residence or outside Canada. In such cases, the information is subject to the laws of the jurisdiction where it is stored and could be subject to government access in that jurisdiction. Tech-Eyes takes reasonable steps to confirm that any third-party provider it works with maintains appropriate privacy and security standards. 

Data Retention Schedule 

Tech-Eyes only stores personal information for as long as is reasonably necessary to serve the purposes stated herein, or for any other purpose required by law, regulation, warranty, accounting, tax or for fraud prevention. Information previously used for these purposes is securely erased, anonymized or otherwise destroyed as appropriate when no longer needed for such purposes. 

Children’s Privacy 

The collection of personal information is never made directly by Tech-Eyes from a child, unless it is reasonably necessary to provide a product or service requested by a child or is authorized by law. If parental/guardian consent is legally mandated, Tech-Eyes will reasonably attempt to obtain consent prior to processing the information at issue. 

Automated Decision-Making 

At this time, Tech-Eyes does not rely on automated processing alone to make decisions that produce legal or similarly significant effects on individuals. If this practice changes in the future, this Privacy Policy will be updated to reflect it. 

Security Measures 

Tech-Eyes uses a combination of administrative, technical and physical measures to protect personal information from unauthorized access, use, modification or disclosure. This may involve using encryption for sensitive data when appropriate, multi-factor authentication on administrative user accounts, role-based access controls to ensure employees can only access information relevant to their role, secure password practices, and monitoring network activity for unusual activity. While there is no 100% security, these layers help minimize risk.

If Tech-Eyes confirms that a data breach involving personal information has occurred, Tech-Eyes will promptly investigate the incident, take reasonable measures to contain any unauthorized use of the information, and evaluate the risk to those who may have been affected. Tech-Eyes will advise affected customers and the appropriate regulatory bodies, as directed by law. A record will be kept of any incidents that have been reported, and steps will be taken to ensure that this does not happen again in the future.

The Tech-Eyes website uses cookies and similar tracking technologies to support core functionality, understand how visitors use the site, personalize content, and measure the performance of marketing efforts. These can be essential cookies that enable the site to function, performance and analytics cookies that help us understand how the site is being used, functional cookies that remember preferences, and marketing cookies used for advertising. The customer may control cookies by adjusting their browser settings or using any cookie-management tool provided on the website, but some website features may be restricted if the customer disables certain cookies.

Tech-Eyes website may contain links to third-party websites, applications or services which are not operated or controlled by Tech-Eyes. The privacy practices, content and security of those third parties are not under the authority of Tech-Eyes, and customers are advised to read the relevant privacy policy before providing any personal data to them. 

Complaint Procedure 

If a customer is not satisfied with Tech-Eyes adherence to this Privacy Policy or any privacy law, they should contact the Tech-Eyes Privacy Officer for a complaint. Every complaint will be dealt with fairly, and the customer will be notified of the result within a reasonable time. If the customer is not satisfied with the answer, they can take the matter to the Office of the Privacy Commissioner of Canada or another relevant regulatory authority. 

Employee Confidentiality 

Any employee, contractor, or authorized service provider who has access to personal information must maintain the confidentiality of that information, complete appropriate privacy and security training, adhere to internal information-handling protocols, and access customer information only to the extent required to fulfill their authorized duties. 

Account Closure 

When a customer account is closed, it does not delete all personal data related to that account. Some records may be required to be kept after that for warranty administration, fraud prevention, accounting needs, legal compliance, dispute settlement, or other lawful business functions allowed by law. 

Practical Examples 

Example 1 - Repair Diagnostics  

A customer submits a phone for repair, the technician requests the device passcode, the passcode is used solely to test the completed repair, and it is not retained afterward unless there is an operational need to do so. 

Example 2 - Marketing Unsubscribe  

A customer unsubscribes from marketing emails, promotional messages stop being sent, and essential communications such as warranty and order notifications continue as normal. 

Example 3 - Deletion Request  

A customer requests deletion of their personal information, their marketing profile is removed, and any warranty-related records are retained only as required by law. 

Example 4 - Address Correction  

A customer reports that their address on file is incorrect, their identity is verified, and the record is updated accordingly. 

Example 5 - Third-Party Payment Processing  

A customer completes payment through a third-party processor, Tech-Eyes receives confirmation that payment was successful, and the full payment card details are handled according to that providers own security standards rather than being stored by Tech-Eyes. 

Tech-Eyes reserves the right to update this Privacy Policy as its operations, technology, or legal obligations evolve. The most current version will always be available on the Tech-Eyes website, and customers will be notified of significant changes where appropriate. This policy works alongside the Terms & Conditions, Repair Policy, Warranty Policy, Shipping Policy, Store Pickup Policy, Return Policy, and Refund Policy.
